Legal Question in Employment Law in Florida
Current Employer not paying sales commission.
I am a sales and marketing rep for a home care company and am currently not getting paid my commission for the month of October to present. They keep telling me it will get caught up. Is this legal?? What actions can I take to get paid??
Thank you

Re: Current Employer not paying sales commission.
You are entitled to your commissions. You should request it in writing and then, if necessary, have an attorney write a letter depending on the amount in issue or file a small claims action. If you need further advice, please feel free to contact my office.

I have seen this happen before. you should be cautious about the company's viability if they have been paid and have not paid you. There is certainly legal relief available, but you should immediately ask yourself if you should continue to extend "credit" to this company. Remember, that is precisely what you are doing. You have done everything necessary to be paid and they are asking you to extend them credit (in all liklihood without interest) for this amount. If you care to discuss this in detail, you can contact me at through the florida bar website for a free phone consultation.
