Employer's Breach of Promise
I am a 55 yo, white female, high level manager (Dir. of Nursing) for a large, private, for-profit, health care corporation. After 6 1/2 years with excellent outcomes and performance evaluations, I resigned my job last week (with tacit encouragement to do so from my bosses) and gave 30 days notice. I also had accrued 12 days of unused earned vacation time. My boss and the regional manager told me that in light of my accomplishments and tenure and in appreciation for all that I had done for the company, they would pay out my notice and let me have some time to plan for the future. They asked me to transition my duties to an assistant and plan to go ahead and leave that day. I did so and left at the end of the day. It was an amicable separation. Today, my immediate boss phoned me to say that my vacation time would be INCLUDED in the notice pay out amount and not in addition to that pay out as I was told on my last day. I told him that I would not be happy with that arrangement and he said he is just doing what he was told and really has no choice. It's a turn of events that I feel to be a breach of the separation agreement, and I would like some advice. What are my options at this point? Thank you.

Sue them in small claims court for breach of the promise, assuming that the amount in question is $5K or less.
