had outstanding perf eval for 2006--
recvd merit increase of 5% = $4300.
again for 2007 had excellent review
and recvd merit increase of 3%---
however just told that last yr--name
removed--merit
increase was only a ''bonus'' (we
were never told this) so it did not
increase my salary--therefore I am
being told my salary is $83000 not
$87200 and this years merit increase
will be smaller as well since based on
lower amount. I think this is
unacceptable as I was never told this
until now May '08, when the increase
went into effect 1 '07. it was paid as
an increase on each paycheck, not as
a lump sum bonus. do I have any
legal recourse. I expressed my
dissatisfaction with my manager and
indicated this was unfair, ie. I filed fin
aid apps for my son for college and
gave my expected income based on
what I thought my salary was. (I am
raising my three kids so even
though a good salary I support my
kids alone). my primary objective is
having the company stand by their
original merit increase even if they
need to get creative at this time.

Unless the merit increase was described as a pay raise, you are out of luck. In any event -- even if it was a pay raise, without a contract, the company has the right to lower your salary.
