Equal Pay

I work for a company that has recently merged with another company. I have retained a position with this company but not the one I started with. When talking to the HR people about various job postings I am told that even though the job requirements are more than my current position it would only be a lateral move (no increase in pay). I asked and was told that an external candidate has more negotiating room when it comes to salary so basically they could be paid more than the company would pay me. Is this fair/legal?
