Florida is an employment at will state. So you can fire an employee for any reason or no reason as long as it is not in violation of a state or federal statute. These would include those pertaining to overtime laws, workers compensation, age discrimination, pregnancy discrimination, disability discrimination, etc. You may want to confer with an attorney to ensure that your termination does not violate any of these statutes. Also best practice would be to have a series of warnings in writing and signed by the employee before termination. You could feel free to call my office to discuss this matter.
