Legal Question in Employment Law in Florida

Forced to resign under duress

Despite excellent job performance ratings, my employer offered me a choice of resigning with two weeks' pay or being terminated. I resigned. I wasn't given a reason other than I ''wasn't a good fit.'' I was the only minority on the management team and I had requested 1-3 weeks of FMLA the day before I was asked to leave to have surgery I had been putting off. I have never been asked to leave a place of employment before, so I am not up on any discrimination or FMLA provisions. Was FMLA violated in this instance? It is possible I didn't ''fit'' because I'm a minority?

Could be possible FMLA violations or even race discrimination. Call my office if you want to discuss further but for certain types of claims you need to file with the EEOC ASAP.

Re: Forced to resign under duress

FMLA may have been violated since you requested the leave. I think you should definitely contact an attorney and go into more details. If you would like to contact my office, I would be pleased to speak with you.
