Legal Question in Employment Law in Florida

hostile work enviroment

i have worked for my present company for 9 years in the same position. a few months ago a female co-worker was moved into my area to work. this female co-worker on a daily basis uses sexual comments to both customers and co-workers. i reported this bahavoir to my direct supervisor as we have a zero tolerance policy for such behavoir. my manager addressed the issue with co-worker, but not as a company issue. the manager let the co-worker know that it was me that was offened by her remarks. this issue also became an internal investigation within my company. i was questioned by the human resourse dept and was told there were alot of issues under investigation. my work enviorment remains very hostile, there are days i go into work and no one in my work area speaks to me , comments are directed at me by this co-worker. the h.r. dept still has not responded and its been 2 months.any advice

Re: hostile work enviroment

If the company does not take corrective action, you will have to file a complaint with the Federal Office of Equal Employment Opportunity Commission. At the same time, you might as well also file a complaint with the Florida Department of Human Relations. Before you file a lawsuit you need to file a complaint with the EEOC. The Complaint has to filed without a significant delay. There is an extremly short statute of limitations. DO NOT SIT ON THIS.

You mentioned that you have been employed by the company for nine(9) years. How has the company rated your performance? Have your reviews been

positive?

You should schedule a formal consultation with a lawyer. A good means of obtaining an attorney referral is by contacting your State's bar association or your local county bar association. They probably have a web site and charge a nominal fee for the referral. Most attorneys either provide a free initial consultation, or charge a nominal fee. If you are located within the Greater Tampa/St. Petersburg area, I would be happy to meet with you

Good Luck, Elliot Jay Goldstein (I also maintain a Tampa office)
