Legal Question in Employment Law in Florida

Still not paid

I was working for a company, but when I got my DUI I was terminated. I had returned the store keys and I was then told that my last check would be in the mail, however it has been over a month and yet I still don't have a check. Is there a law against this?

In Florida, enmployers are required to pay their employee's the last paycheck on the next regularly scheduled payday. So they should nave mailed it to you on what would have been your next paydate. You can always give them a call and say that you haven't received it and need it right away to see what they say. This might just resolve it right away. If you haven't done so already, it is in your best interests to make a written demand for payment of your final paycheck in a letter sent certified mail, return receipt requested. Ask that they provide it to you within 10 days of receipt of your letter, and if they should fail to do so, contact an attorney or you can file a small claims case on your own if its $5K or under.
