You can sue in small claims court if under 5,000.
Re: Post employment paycheck
Both Florida law and Federal law protect most people in this situation, depending on the nature of your job and how you were paid. If you fall under the protections of the law you may be entitled to recover double the amount of your last paycheck and attorneys fees and costs as well. To determine what if any recourse you may have you must speak with the Department of Labor or a private attorney. I regularly handle these types of cases and would be happy to speak with you. Feel free to call me at (877)456-WAGE to discuss this matter further.
Re: Post employment paycheck
Regarding a last paycheck issue, an employee is protected by both state and federal laws. However, please know that the employer does not have to provide you with your last paycheck on your last day. An employee's last paycheck is due on the next normal pay day.
Once this date has passed and no check has been received, you have a valid claim. You can contact the Department of Labor or an Employment law attorney. Under both state and federal law, you may be entitled to more than what you earned if a lawsuit is filed. Plus, you can get the employer to pay for your attorney's fees and court cost. Feel free to contact our office for more information or assistance.
