probation period
I am on a 90 day probation period at my job. I started 9/27/07 which makes 12/25/07 (Christmas Day) my 90th day. The employer doesn't want to pay me for 12/25/07 or 1/1/08 because I took a one week unpaid vacation in November. They knew of this vacation prior to hiring me. They state my 90th day will be the 4th or 5th of January. Please advise. Thank you in advance!

There is no requirement that they pay you for a holiday. If they want to count the 90 days in the way you outline they can. Probation isn't really a legal concept. In Flordia, you are an at-will employee. Your employer could fire you before the 90 days were up if he wanted. Thus, if you think they are going to keep you, I would let this issue go.
