Reference Retaliation
I was working for a community college in florida. My daughter was also a student. We are from Ukraine but are US citizens. My daugther's teacher kept giving her poor marks for her work. When my husband and I asked him what the problem was her teacher said she was not born here. Her work in all other courses including English was all A and she is a national honor sociciety student. We charged the teacher with ethnic discrimination. The school's internal review aquitted him but shortly after my position was ended due to maxium part time hours. When I applied for another job and attempted to get a reference from my supervisir, he was told not to give me one by the head of HR. Since that time, (april 2007) I have not been able to secure a job as everythine I apply, I get a positive response but then, after the potential employer requests a reference from my former work, I get declined without even having an opportunity to interview. I believe the college is using retaliation against me for speaking up for my daughter. I have also found that this same college has had a history of legal isssues for sexual misconduct by their officals. Do I have a case for employment discrimination base upon retaliation for speaking out?

You probably need an investigator to call for a reference as a prospective employer to see if they are defaming you. If so, you might have a claim for defamation.
