Legal Question in Employment Law in Florida
South Florida Reading Specialist terminated
I taught in a South Florida school district for 5 years (199-2004). I began teaching at a high school another South Florida school district in August04.References were checked and all paperwork was complete. I was hired in 07/04. On 8/27/04,the principal said that instructional staffing received a negative recommendation from my previous principal.I was asked to resign or be terminated.Various grievances had been filed against the previous principal. I've had satisfactory evaluations since 1999.The current principal and instructional staffing rep. said that the principal said that,''I should not be around children and that I had to be escorted off of campus.'' That information was damaging and fradulent. I had moved on 7/31/04 to the 2nd South Florida school district. I am currently unemployed. What can be done when a previous employer provides false and damaging information that results in the termination of employee? Also, what can be done when an employee is cleared for hiring after references had been checked, but then fired a month later because of one reference? FYI: Hiring policy at the 2nd district requires 2 years reference/s from previous principals; I was there 1yr. Previous school had a positive recommendation.

Depending on the specifics, you could have a claim for defamation/violation of the florida statute which otherwise provides immunity to employers for knowingly false job references. Please contact us at (561) 447-8888 for further assistance.
