Terminated rights

My husband was recently fired from his job because of an IM conversation he had with a former employee (they say he was giving away company secrets when they were talking about family). When he came back from lunch his boss would not let him in the door and forced my husband to make a list of his personal items on his desk. He was given a personal laptop instead of a raise and that was taken away. He has not been able to get his personal files off the laptop, get his personal belongings off his desk, or get his last paycheck. His old boss has threatened to call the police if he ever comes back. What rights does he have to get his stuff back?

He has a right to that property which is in fact his. However, the files on the laptop may be a tough issue because if the laptop is the ER's, the files on the laptop are probably the ER's property vs. your husband's. Send the ER a written request for date to pick up all personal property and if that is ignored, have him show up. I wouldn't be too concerned about the police, if they should be called, he hasn't done anything except request his property be returned. As for his last paycheck, include a demand for payment in the letter as well.
