Tuition Assistance

My boss wants to offer tuition reimbursement to some employees but not to ALL. Can this be viewed as discriminatory? Does he have to create a written policy?

It is discriminatory in the strictest sense of the word, but it is not improper discrimination. The employer does not need a written policy.
