CAN HE KEEP MY SECURITY DEPOIST IF I NEVER MOVED IN?

I signed a lease on 4-13, and returned it back to the potenital landlord along with a security depoist on 4-17 (which he required). From the time I frist spoke with him he said that the house would be ready for me to move in no later than 4-30-10. Long story short come Friday 4-30-10 the house is still not ready as a matter of fact the other tenants was still living in the home. I met him at the house late Saturday 5-1-10 evening, the place was a mess inside and out. He told me that he needed until that Tuesday (5-4-10) to get the house move in ready. He still does not have the house finished Tuesday or Wedneday or even Saturday 5-8-10, at this point I had to pay rent where I was living or be homesless and notified him of that. Now he is saying that he's keeping my depoist. Please help.

Take him to court - he can not keep your deposit.
