Re: Tenant Breach of Contract
Dear Madam or Sir:
One of my tenants has decided that she can no longer live at my home because she lost her job and further due to a surgery she is scheduled to have within the first two weeks of December. However, she seems to always be in the best of shape, and I have reason to believe that she is feeding me nonsense.
She signed a contract for one year, with the stipulation that she would need to advise the landlord, me, if she ever decided to terminate the lease...I would have to agree in writing. However, I truly don't agree, and either way, she still does want to move out.
What leverages do I have, and how can I protect myself in the future? Is it possible for me to stop her from moving out? Lastly, when she does leave, how can I make her pay for damages I have incurred? She still has seven months left on her lease agreement.

You can sue her for the remainder of the lease if you are unable to find a tenant to mitigat your damages. However, if your lease is ambiguous in terms of her being able to terminate it then you may have a problem. It would be important to see the lease.
