Legal Question in Legal Ethics in Florida
Florida board of nursing. First time applying for RN Licensure.
18 years ago, I was arrested for felony possession of drugs in Washington State. I entered a plea of Not Guilty. Motion for stay filed and granted, and I was referred to diversion. Plea was not changed.
I completed diversion, and case was dismissed with prejudice.
The application criminal history question asks:
Have you EVER been convicted of, or entered a plea of guilty, nolo contendere, or no contest to, a crime in any jurisdiction other than a minor traffic offense? You must include all misdemeanors and felonies, even if adjudication was withheld.
_______________
Do I need to disclose this? I know it will appear on a background check, but my answer to the is no, I was and did not.
1 Answer from Attorneys
as phrased you likely have to answer yes, no is inaccurate based on your fact pattern. you need to get all the papers and make sure what they state. you were likely sent to pretrial diversion as a first time offender. either answer yes or inquire of the board whether your circumstances require a yes or no answer.
