Attorney ignoring settlement offer

Can an attorney ignore our directions and not offer a counter settlement offer to a defendant we are suing and thereby let his offer of settlement expire? We have told both verbally and in writing that we want the present lawsuit we filed to end and want to reach a settlement. However, our attorney who is ''court bound'' ignores us and does not respond to our e-mails. The defendant has a hearing scheduled shortly for a Motion to Dismiss the suit with Prejudice. Can this attorney continue to ignore us so he can attend the hearing to simply garnish legal fees. This attorney has billed us $17,000.00 so far for a lawsuit that this attorney admitted in which the defendant is probably Judgement Proof. How can we stop our attorney?

You need to fire him. He is duty bound to communicate any settlement offer you instruct him to convey. Get another attorney and have him follow your instructions. Since this is in litigation, you should contact someone local. If I am local to you, feel free to contact my office.

put it in writing. The attorney must follow your direction to make a settlement offer if you have so directed.
