Legal Question in Medical Malpractice in Florida
Blue Cross and Blue Shield had me sign a medical waiver over 9 years ago. I changed policies within the company over a year ago and didn't remember any waivers, nor were they called to my attention. Then I had to have surgery a few months ago for the condition under the waiver and even though the surgeon as well as the hospital called BC/BS for insurance approval and it was given, they have turned around saying that it was not covered. They had paid a few of the small office bills, so I assumed all was okay. Is there anything I can do legally about this matter? They now say I owe over $50,000!

Usually waivers are just for around 2 years. You need to see the waivers and paper work BC/BS is relying upon. If you have a new policy, I would not think the old waivers would apply. Assuming that the waivers apply, estoppel is the argument.
