Legal Question in Medical Malpractice in Florida
Retired military person goes to civilian doctor for routine procedure. I was put to sleep via IV which was placed in the hand. Procedure completed and patient released to home. The following day the patient noted swelling in the hand but dismissed thinking temporary, however the swelling as the day goes extends up the arm with tenderness. The patient called the doctor for guidance and was told that the arm maybe infected and to elevate the arm for the night and go to the Emergency Room the following day. The patient also called the Clinic were the procedure was done and spoke with a nurse who told patient to go to the Emergency Room immediately. The patient went to the ER on a military base, and a ultrasound was done and the patient was informed that the arm has a bloodclot. Patient was given Xarelto a Blood thinner and sent home and told to see their regular PA in 24 hours. My question is Do a have a malpractice action against the civilian doctor that performed the procedure?

If, the blood clot is within the normal risks associated with the procedure than no claim. if not, than you could have a claim, but you would also have to have a permanent long lasting injury associated with the error as well. if the problem resolved, than no claim would be worth pursuing. seek legal advice with all your details.
