Legal Question in Military Law in Florida

Ucmj Larceny

I want to know what kind of disciplinary action I would be facing if convicted of larceny (between 10 and 15,000 dollars)by the military. I have never been in any type of trouble at all before.

Re: Ucmj Larceny

Speaking as a retired US Military Judge, this is a simple question with many possible answers. Depending on the particular facts and circumstances, including how the offense was committed and who the victim was - your case would likely be sent to a General Court-Martial. The maximum sentence for one offense is 5 years confinement, plus a Dishonorable Discharge, loss of all pay/and or a fine, etc. But if the thefts happened over multiple times each time could be charged as a seperate offense making the maximum punishment much greater. Theft of military property is a more serious offense. Plus other crimes may have been committed in the course of the theft(s). As an alternative your case could go to a special court-martial where the confinement is limited to 1 year, and there are other limits on punishment.

The bottom line is that you are facing a serious charge which, if convicted, will follow you outside the military as a federal criminal conviction. Accordingly you should seek the most experienced legal counsel you can find to help you.
