what can i expect from claims adjustor

I was hit, suffered bruises, broken rib. The other driver accepts liability. I am not disabled, but am still in pain nearly a month later. Am I entitled to a settlement? What determines amount of settlement.

The law only allows you to collect from the other driver's insurance if you have a serios or permanent injury. Until your doctor releases you, you wont' know just how seriously you are hurt. In the meantime, you can require your own insurance carrier to replace your wages and pay your medicals. Call to talk! JMC

You do not have to be disabled in order to settle a BI case. Under the Florida No Fault Law you are required to have a permanent injury in order to recover for any pain and suffering, otherwise you are limited to recovering 80% of your medical bills and/or 60% of any lost wages from your own insurance company.

A broken rib is a very serious injury, not to mention very painful. With that type of an injury you will be able to recover for pain and suffering. Unfortunately, there is no magic formula to determine what your settlement will be. It will depend on the insurance company the other driver has, the adjuster you get, the amount of property damage, your past medical history, the details of the accident, etc.

If you are trying to pursue a settlemnt you need to obtain a lawyer. All lawyers handle these type of matters on a contingency fee basis, thus you will not have to pay for the lawyer unless they recover money for you.
