Legal Question in Personal Injury in Florida
I was involved in an accident on a very busy highway in a town outside of Tampa Florida. I was in a right hand turn lane and heading to an intersection to make a right turn. Traffic in all three lanes on the highway were stopped at a red light. A small woman jumped out from in front of a truck coming from the median to the side of the road where I was, She thought it would be a good idea to cross in the middle of the highway, instead of 100 yards away at the cross walk. Needless to say she literally ran into the driver side of my car. denting my wheel well, breaking off my mirror, and messing herself up pretty bad in the process. Now come to find out she lives in a motel and works across the street at a strip club, where she dances for a living. She has no vehicle, cell phone, home or anything. So now I have a broken down car, which I am still financing, and a $500.00 deductable, that I dont have the means to pay. I work full time and just started renting my first place. I am just making ends meet, and now I have to put in a work order with a body shop to get work done, then send the insurance check I did get, which wasn't much, to my finance company, so they can sign off on the check, and then sign all that money over to the body place. Which also would need the other $500.00 to fix everything. SO as you can see I am in a bind, and I really don't know what to do. I want to take her to claims court to get her to pay my deductable, but like I said before, she is a stripper who lives in a motel... not much I could really go for I would assume... Please o please help me.
