Is this legal malpractice?
I just settled a 4 year long PI case in which I rec'd less $ than the medical bills incurred.
My attorney knew I had no personal insurance coverage and sent me to to docs who would only treat me w/ a LOP. I made sure every doctor and I had a copy executed in our presence. None would not treat me w/o one.
I settled because there were 3 weeks left to my SOL (statue of Lims) and my attorney has been deathly ill for 6 months (liver transplant) and he has not returned my calls for over 10 months-he had some other ''firm'' -friends- contact me the 1st week of Dec. 06 and ''finish it up''?
What was not disclosed to me until after the settlement was executed was that out of 16 LOP'S-my attorney only signed 5!!!!
Fianally my attorney called last week and tried to use his illness as an excuse, but the treatment and bills incurred were from over a year and 1/2 ago, before his illness. He says its not his problem and tells me he will sue me for eveything I have if i file a complaint against him with the Florida Bar. I am so distraught! this man was supposed to help!
I am stuck with appx. $14,000 of unpaid medical bills and need the little bit of money I have left to get surgery/bills paid-treatments..

You should never fear filing a Bar Complaint if you feel you have been screwed. The attorney is bluffing in my opinion. Even if he isn't, there's no claim against you assuming that your Bar Compaint is not fraudulently made.
