How are settlements reached?
I was involved in an accident on 6/24/2001. I am confused on a couple of issues 1st my lawyers assisatnt told me if the person who hit me does not carry bodily injury I will have to sue my own insurance co, and I could only sue for 20,000. They also would not say how much I could be looking at if he did carry bodily injury, I know people who have gotten upwards of 60,000 just for a TMJ injury, I have 3 differnt injuries, what could I possibly be looking at as far as a settlement? Also I was fired from my job for being out on disability, my pip coverage has been exhausted, and now I have no income but still have bills am I eligible for disability from the state, until this settles?

A. If the person has no insurance or assets it would be a waste to sue him you therefore proceed against your own insurance company.

A. A number of factors go into that equation. Including the skill of your attorney in convincing a jury of your injuries worth.
