Legal Question in Real Estate Law in Florida

how do I buy out partner in condo who doesn't want to sell

I am an equal partner with another person (not related) in a condo. We share expenses 50/50. There is a mortgage. I am living in the condo. She is in NY. I would like to buy her out or have her buy me out. I have offered her a fair market buyout. She has refused. Title is "joint tenancy- right of survivor" so I have been fearful of paying off my half of mortgage because my heirs would lose all if I died. The cost of this partnership is killing me. I recently sold my place in NY and need a permanent home in Fl. Can I force a sale in FL How ? ? ?

Of course it would be best for you and your partner to reach some settlement of this issue privately. If that cannot be done you can bring a legal action to partition of the property. Where property cannot be divided without prejudice to the owners, such as your condo, then the court has the power to order the property sold at public auction.
