Legal Question in Real Estate Law in Florida
I was divorced five years ago. As part of the divorce I signed a quit claim deed to the house. I wanted to just get out of the marriage as quickly as possible. I did not get any type of payment for the house. As part of the divorce contract I was also supposed to be removed from the mortgage. Now my ex emails me telling me that I need to file a corrective quit claim deed so he can refinance. The divorce was VERY bad and I do not want anything to do with him. Furthermore, I don't know why I should be signing a corrective quit claim deed or what the legal ramifications are. After this surface, I also found out that I am still on the mortgage! As far as I know he has been paying for the house. Also, since this has been dragged out I would like to reclaim my half of the house. What should I do?

This is a common problem with banks failing to take people off the mortgage for their own financial interest. File the corrective deed if you want nothing to do with him as that was the intent of the agreement and a judge likely would require you to sign it.
