Financial Responsibility

My apartment was burglarized by workers employed by my

landlord. Items were stolen and checks were forged and

cashed. They were arrested and some of the items

located at a pawn shop. I had to pay $250 did get my

items out of pawn. Should my landlord be responsible,

and can I deduct my losses from my rent pay

The landlord can be made responsible for the acts

of his employees or independent contractors for

acts done during the course and scope of their employmnent.

There are cases that state employers are not liable

for the criminal actions since they are not done

during the course and scope of their employment. However,

there is a trend to make employers responsible through

various other theories such as they knew or should

have known such actions could take place, they were negligent

in hiring the employees', etc. You would need to file

suit, establish liability and obtain a judgment. I

would not advise you withhold rent.
