Legal Question in Real Estate Law in Florida
Hello,
I am renting an apartment in Fort Lauderdale Florida for almost 18 months now. I am half-way of my second annual lease that I have with my landlord. I have never been late with a payment or had any problems with my landlord whatsoever. There is some discrepancy between the landlord and the association and I am stuck in between. The association sent me a letter that I need to pay them, since the landlord owes them some fees. I called my landlord and he asked me to pay him.I recently had an identity theft. How could I possibly send a rent check to someone I have never heard of? I have a lease with my landlord and were never required to deal with any association before so I keep paying him. Now I am sued by the association in the subpoena it says that they sent me a Certified Letter to leave the property in 3 days. the letter was sent two months ago and it is a scam, because when I run it through the tracking system of USPS it says it was delivered at the address of the plaintiff's attorney, not MY APARTMENT. So obviously it is made up to defend their case.
My question is how to protect myself? Could I file a counter-claim for harassment, attorney's fees and damages. Can I obtain restraining order so I don't get evicted with my underwear on, when I have been paying my rent promptly and I have responsibilities toward my landlord only according to my lease. How much I can sue them for? Do I have a chance to win?
Thank you in advance

Retain counsel to defend you. If you screw up, you can be evicted and have a money judgment against you,
