Legal Question in Real Estate Law in Florida
Can I hire someone to trim tree branches on neighbor's tree that overhangs my property? Located in Spring Hill, Florida
1 Answer from Attorneys
Yes, you can trim branches that overhang your property. Cut directly over your lot line, and do not damage the trunk of the tree. In the event that a large branch threatens your safety or your home, talk to the neighbor about getting the branch cut back in such a way that if it falls, it will not fall in your yard or on your house.
Some trees are protected (Such as Live Oaks). You will want to hire a licensed and insured tree trimmer to be sure that no laws are broken during the trimming process. A licensed trimmer should know just how far they can cut on a neighbor's tree.
If your neighbor's tree is still a hazard to your safety or home, and talking to him does not convince him to take action to cure the problem, then see a general practice attorney. Take photos and document your attempts to cure the problem.
