Legal Question in Real Estate Law in Florida
My husband and I were divorced in December 2011. My ex-husband and I are both on the deed of our primary residence in Tampa, FL. The house is currently up for sale. We are to equally share the net proceeds from the eventual sale of the house. The original mortgage is in my ex-husband's name only and he recently said he had refinanced with the same lender to lower the monthly payments and extend it out. Is it possible for him to be able to refinance without my approval since I am part owner?

Yes, he may refinanced without your approval since he is responsible for the mortgage.
