Legal Question in Real Estate Law in Florida
If name is on mortgage, but not on deed, what are the laws?
My wife and I refinanced our home which she owned prior to our marriage. She took out the equity and paid off her debts, and we took out the mortgage in both of our names. Somewhere in the process, my name was not added to the deed. Is this an area of concern in the future if there is a divorce?

Yes, it could be. You still own as tenant by entireties technically, but its much easier if you just get on the deed. A simple quit claim deed could fix the problem. Email our office for more info, we process those every day. [email protected]
