property in Florida. owner passed and executor said he does not have rights to sign deeds, wants to sell to us. How can we buy the property?

Hello. The executor has to open a probate estate in the county where the owner lived prior to owner's death. Once the probate estate is opened, the executor will have power through the court as the court-appointed executor to sell the property.

The personal representative has to open a probate estate to clear the title in the property to the heirs. There are no executors in Florida. The sale of the property will likely require a court order.
