Legal Question in Real Estate Law in Florida

Restrictive covenants

In Florida, can a member of a Residential Community (as defined in the Florida Statues) sue the homeowner's association if they do not want to accept the association's restrictive covenants on home design to which they have agreed?

Re: Restrictive covenants

Anyone can file a complaint against any party making allegations that the plaintiff believes constitutes a valid cause of action. Whether the complaint is legally sufficient (meaning it will not be dismissed because it is legally deficient on its face) is another question. This is not the kind of issue that one can respond to properly only with the limited facts you have provided. You need to seek the advice of counsel. Good luck.
