The answer depends on the terms of your agreement and the specific facts of your case.

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorneys individualized advice for you. If you do not agree, then stop right here, and do not read any further.
RESPONSE: The answer to your question will largely depend on the terms of your contract. However, have you placed the contractor on notice that it provide you with adequate assurances that the sinkhole will not impact the structure of your house? Has the contractor tried to fill the sinkhole? Did you hire an expert to evaluate whether the house, as planned can be built safely and without defects accruing? Is the house being built on pilings? There are many questions that need to be answered. Therefore I recommend consulting an attorney whose field focuses on construction litigation. Good luck, and if you need further assistance, do not hesitate to contact us.
