my tenant moved out 1wk early & paid the rent a week late with out including the late fee charge. also left the conod dirty and damaged. Am I required to refund pro-rated rent & security deposit?

You can send to them the 15 day security deposit notice letter for damages. However, if you fail to send it out timely and/or fail to follow the statute EXACTLY you will lose. The late charge is something you would have to file a small claims action against to obtain, and it is rarely worth it.

Better go to a Landlord/Tenant attorney to do it right, or you will be paying the tenants attorneys fees and costs too.
