Legal Question in Wills and Trusts in Florida

Court judgement

In 2005, I won a court judgement. In 2006 the debtor passed away, he was quite wealthy. There is no record of a will being probated. Is there a way to confirm payment of the judgment to the courts? I am at my wits end. The family will not speak to me or tell me who is the representative of the estate. What am I to do?

You can open an estate in Florida as a creditor. You can then do post-judgment discovery of the family to locate assets. However, if the assets were transferred via a trust or other transfer prior to death, you may be spending good money to go after bad. this also assumes you took the proper measures to certify the judgment as a lien after receiving it, and that the judgment was properly entered. You should go to a lawyer for advice.
