Legal Question in Wills and Trusts in Florida

my mother in law passeda way and she has a claim with BP and i need know how my husband and i can get the claim processed?? I spoke with them and they said that we have to open an estate, but its the only thing that would go into it. Is there any other possible way to get the money with out opening an estate?????

No. Only an appointed Personal Representative can bring or maintain a lawsuit on behalf of a decedent. The claim would be the only assets of the estate.
