here is the problem, My husband's parents are both deceased and no will. all the other siblings live out of area. there is a squater staying on the property and making a junk yard out of it,County is getting complaints. Our hands are tied. is there any way my husband can become the overseer of said property to keep the squater off without going through probate. Re: property rights

Probably not. You need to bring a probate. Depending on how the property was titled, and how long parents have been dead, a probate could be fairly cheap, simple, and quick; but so long as no probate is opened, you are going to have a problem trying to get someone out.

Call me or another probate attorney.
