Legal Question in Wills and Trusts in Florida

Protecting Real Estate if Nursing home care is needed

I am disabled and will need nursing home care in the future. The only assets I have is my home. How can I protect this asset from being sold to cover nursing home care? I wish to pass this asset on to my ex-wife when I die.

Somebody told me that if I put her name on the deed now that they would not be able to force her to sell the property to cover my medical/nursing home care. I am on Medicaid/Medicare now.

I know I will need this type of care for I have MS and am slowly going down hill.

Re: Protecting Real Estate if Nursing home care is needed

You may want to consider an Enhanced Life Estate (offers more protection than a regular Life Estate). If you put her on the deed now, she will have control and ownership rights while you are alive.

Please feel free to call me should you have further questions.
