Legal Question in Wills and Trusts in Florida

Real or fake will?

My grandfather recently died leaving no will. As he lived in Florida, his estate has been in probate until his estate is settled. Last week a will was ''discovered'' by the attorney who told my family that he didn't leave a will. This attorney has made no attempt to contact us or give us any futher information. (We recieved word about a will through another attorney working on a different settlement.) Can this will be proven to be false, as we believe it is?

Re: Real or fake will?

Probate is the procedure to prove that a document is the Will of the decedent.

Once the Will is presented for probate, it can be challenged by any person who stands to gain by having it rejected.

Under certain circumstances you would be eligible to challenge the Will that you think is a phoney.
