title and mortgage issues

My hubby and I are 1/3 owners of a duplex purchased from my mom a year ago, she is 1/3 on title, but not on mortgage. She is not paying the bills, ruining our credit and jeopardizing our home. Do we have any legal action?

The recourse for a property owner when another owner is not paying property expenses is to file a partition action. In this sort of case, the property can be ordered sold and all owners are credited according to their interest in the property. All parties are also credited or debited for the amounts they have spent to support the property.

You can file suit with the court to have the house sold.
