Legal Question in Workers Comp in Florida
Husband was hurt at work while working in CA, he spent 2 months in hospital and Rehab in CA and is currently in Atlanta at the Shepard Rehab Insitute , His company is FL based and have been excellent. They have paid for my living expenses and transportation while I have been at my husbands side and have also been with my husband when I could not be. What do you think will happen if my husband cannot return to work? He is currently 64 and will be 65 in Dec and had planned to work till 67 to pay off debts before retirement, What if he has diminished Quality of life? Lost wages for me while attending my husband?
Will the Insurance company offer a settlement for all these things, Will his WC Insurance conitinue to pay for his medical expenses due to injury for rest of his life if necessary ? When all is said and done I do not know how to handle this?

In Florida, an employer is responsible to pay for all medical related to the accident for the rest of your husband's life, as long as he continues to receive medical care from an authorized doctor within a year or continues on medication. An authorized doctor is a doctor chosen by the employer/carrier. Your husband is also entitled to about 2/3 of his income while out of work. This formula changes based on the status of your husband's ability to work and his medical condition.

First, he was injured in CA. Was he hired in CA and was he paid in CA? Does Florida have anything to do with this claim other than that the company is located in FL? Each state has its own wc laws and structure. You need an attorney familiar with the state that is administering his claims. In Florida you get medical expenses paid and lost wages to the extent you cannot work. There is no money paid for lost quality of life in Florida. You can be compensated for attendant care up to 12 hours a day but it has to be done with a prescription from an authorized physician.
