Legal Question in Workers Comp in Florida

On the job injury State Government

I hurt my back in Nov. 2008. My doctor put MMI Feb 2009. I had to go for more treatment because my back still hurts but I'm still going to work in pain. I requested my one time change of doctor and that doctor have given me a steroid shot in my spine. I'm stil having pain and my pain has moved to other parts of my body.

I was in a car accident in 1995 and that accident left me disabled form 1995 until 2000. Unable to return to work. I was receiving SSI disability. I decided to go back to work because I overall felt better and returned back into the work place full time. I had no complaints of any of my prior disability.

As I mention above about my recent on the job injury, I having continued pain and some days or worse than others. I force myself to go to work because my doctor have returned me back to work and I have exhauslted all of my sick leave and Annual leave and I have four children that depend on me for financial support. I have been work for state government going on abou 6 years. Can you give me any advice? Thanks in advance

Without knowing who the doctors are and what the specific diagnosis is to your back, it sounds to me like you need a different type of specialty, perhaps pain management or a physiatrist. You have used upon your one time change in physician but that doesn't mean that other doctors cannot be authorized that practice in different specialties. Has any of the doctors assigned a percentage of impairment (btw, impairment DOES NOT equate to disability) and have you been paid impairment benefits. The best way to figure out where to go next is for a competent attorney to review your medical records and see if there is a different specialty that may be able to help you. For any questions, you may call me at 561.276.5757. Good luck.
