Legal Question in Workers Comp in Florida

work injury

i hurt my knee in a work related injury in 1999 it was treated but did not really get better cause the surgery needed to fix it was not availible until recently.i was placed on maximum medical improvement in august of 99.ive had incresed pain and some loss of function and there is now a surgery that could benefit me i called the work mans comp carrier and the said the the company that was hadeling the claim went bankrupt but they could forward the request to the state fund handeling there claims but that they wouldnt except it because it has been 2 years since i was placed on maximum medical improvement i would like to know if this is true thank you for your time

Well, the question you ask has many issues. First, I would ask if you had continued treatment since maximum medical improvement? If you had not received medical treatment with two years from the date of accident and/or one year from the date of last treatment (whichever is longer), you may have waived your rights to such treatment later.
