Legal Question in Workers Comp in Florida

workers comp injury question

on February 27th of 2009 i crushed my index finger in a sky lift in between the rail of the lift and an i beam. since then the orthopedic WC doctor has put me on light limited duty with no use of right hand.

my work entails the use of both hands. so i have not been working since then. now i have a new injury to my left arm from over use due to not being able to use my right hand. the injury did not occur at work. it was from doing household things and every day things with my left arm. I now have bursitis or tendinitis in my left elbow. my elbow has swollen up to the size of a small baseball.

will workers comp cover this because it is related to the initial injury? but like i said the second injury did not happen on the job. any help would be great.

if i have to retain a lawyer i will. but if i just called WC up i wonder if they will turn away and tell me to get screwed. ohh im falling apart over here. HELP~

Re: workers comp injury question

I can easily see the insurance company trying to blow you off on the elbow injury. But if in fact the elbow injury is due to overuse, you are entitled to file a claim with the court and pursue benefits for the elbow. I suspect you will need an attorney but so long as we can get the doctor to agree on how the elbow got hurt, its a winner for you. Jane-Robin Wender, Esquire - 561.276.5757
