If you are in an accident, with it being the other persons fault, is there a time limit on when you have to go to the hospital, even if you do not hurt the day of the accident?

I am gathering you are wondering how does a delay or gap in treatment affect your legal case. Every delay, even a day, often diminishes the value of cases in that insurers will be more likely to challenge the severity of the injury or even if there is an injury.

There is no time limit on when to go to the hospital or doctor of your choosing. You should go as soon as you experience pain or other symptoms from an accident. If you wait a long time it will create issues as to the severity of your symptoms and whether they are related to the accident of some other cause. Please be aware that the time limit for filing a lawsuit related to an accident in Georgia is two years from the date of the accident.

I need more information to properly advise you. Is it a neck/back injury? It can take 48-72 hours before pain sets in on a soft tissue injury. Anything more than 3 days and you are properly not going to recoup the full amount of that visit. I would suggest seeing your primary care physician or a chiropractor. They can get x-rays done and determine if you have a fracture.

However, if you hurt your knee, ankle, elbow, etc. (and you are wondering if you have broken a bone), then going to the hospital is completely acceptable within a 1-2 weeks.

Insurance companies generally believe if you are really hurt, then you would have gone to the hospital immediately. So, if you go weeks later, they think maybe you hurt yourself in the yard and are trying to blame it on the accident. Or, you are just trying to pad your case.

If you were involved in an accident and the other driver was at fault (as indicated on the police report taken at the scene), there is no fixed time limit for you to seek medical attention. However, the longer that you wait to seek medical attention, the more likely that you will reduce your ability to be fully compensated by the other driver�s insurance company for your personal injuries.
