Legal Question in Business Law in Georgia
Suing a partner
My partner and I are 40/60 business owners with 60% my share. We invested in a rental property. I have spent over $20,000 on this property and my partner nothing. Can I sue for the 40%?

Re: Suing a partner
If your partner is violating some kind of partnership agreement or his/her fiduciary duty to you or the company/partnership, you certainly may sue for your damages sustained. With regard to obtaining your partner's 40%, you cannot force him to sell or otherwise transfer it to you. Courts will more likely order the dissolution of the company/partnership and you can start over as 100% owner.
