Assuming that you are asking about incorporating in Georgia, registration with the secretary of state's is office is a separate standard than trademark issues regarding a business name. The SOS basically won't allow two very similar names to be registered; however, just because they allow registration the name may still me a trademark violation of a previously used name. I would suggest speaking to a local attorney to determine what name usage.
