Legal Question in Construction Law in Georgia

1 year warranty compliance

We moved in (and closed) in September 2004. Our contract with the builder includes a 1 yr warranty. We have 2 problems (plumbing knocks and hardwood creaks). What remedies do I have to get these fixed? If builder is unresponsive, must I wait a full year from date of occupancy before he is considered in breach of the contract? What documentation should I keep related to my attempts to reach him and resolve these issues?

The answer(s) really depend on the language of the warranty. But make sure you give the builder proper notice and document it. Then you may sue if the builder is in breach.
